I think I have a Lizzie Borden biography at home, which I'll check
tonight.

In the meantime, you might note that in an unsigned story in the
December 1, 1860 edition of <All the Year Round>, a Victorian literary
periodical edited by Charles Dickens, there is a character named
Fortywhacks or Forty-Whacks in a story that starts on page 188;  see

Whether this has any connection at all with Borden is speculative at
best, but it does seem at least a little bit coincidental that the
phrase preceded the trial in at least one context.  Perhaps it was
current in some now-forgotten argot.
