[PW] Help with a reference question

I am so thrilled to find you all.  I was a member of Stumpers back in
the day and really miss it and now you are here!

 

Anyway, here's the question:

We have a customer who is looking for a short story.  This is what he
remembers:

A man on a train was advised by his doctor to take a vacation to calm
his nerves.  He overhears two men in an adjoining booth discussing a
criminal case involving two brothers on trial for killing their uncle to
inherit his fortune.  During the trial, one of the brothers breaks down
and confesses that he alone was responsible for the murder.  So the
trial was declared a mistrial and the prosecuters were directed to
revise the charges.  Meanwhile the other brother was set free.

 

After the brother who confessed was tried and found guilty, the supposed
innocent brother came forward with a confession and evidence that he was
the real killer.  So the convicted brother was set free and another
trial was arranged for the second brother.  At the trial of this brother
the first brother confesses again and brings evidence that he alone
committed the crime. 

Both brothers ended up being set free.

One of the men on the train said "So they got away with it".  The other
replied "That's just the darndest thing about it.  They didn't."  Just
then the train stops and the two men  got off the train and left the
main character hanging, not knowing the outcome of the story.  He tried
to motion to the two men thru the train window but the two men thought
he was mad.
