Wow, this is very interesting!
Thanks for search terms: quain "check engine". It was wise to not search by headline, since headlines may be changed when article is reprinted in another publication.
Thanks for link to same article in Boston Globe http://tinyurl.com/24nb9l <http://tinyurl.com/24nb9l> proving that the article did appear in at least one other newspaper!
(NOTE: though you found article at boston.com, at headline, you can see logo for Boston Globe)
Interesting that it appeared exactly one week after original NYT article (on 7/15).
Interesting to note the different article titles, too.

If you read both articles, they are identical, except for the headline!
Knowing now that this article was published in at least this one source, I went back to Lexis-Nexis Academic, and also another database of newspapers we have and this article from the Boston Globe is NOT included in either database!
It appears that the article probably is freelance and that it may have been made available via NYT News Service (or Syndicate) to other papers BUT that permission for electronic reproduction in databases was NOT given by the author, i.e. Tasini decision, as you suggest. Presumably Mr. Quain okayed electronic version on boston.com web site.

I had the same experience with a PROQUEST NEWSTAND search, and would offer
the same likeliest explanations as Tsviya has.
For what it's worth, I'm pretty sure it did not appear in the (Minneapolis)
STAR TRIBUNE or I would have remembered it.
A google search shows a reprint on boston.com -- I'm not sure if that
means it's from a Boston newspaper or not:

I searched google as
quain "check engine"
and got a number of additional hits, but none of the URLs look at first glance
like those of newspapers. I didn't check them out.
If dedicated enough, one could search papers one at a time from a site like
http://www.ibiblio.org/slanews/internet/archives.html
or
http://www.ipl.org/div/news/browse/US/
but absence of evidence would not be evidence of absence, since I suspect
many such online indexes (like many print newspaper indexes) may not index
reprinted syndicate materials, for Tasini or other reasons.
