I'm not sure this is a court decision but rather a decision by the
school district.

" TALLAHASSEE, Fla. _ For the first time ever, evolution is to be taught
clearly and explicitly in Florida classrooms now that the Florida Board
of Education Tuesday approved a batch of new science standards that says
the ''E'' word.

But there's a catch: Evolution will be taught as ``the Scientific Theory
of Evolution.''

The original standards, updated for the first time since 1996, didn't
call evolution a ''theory'' when it was drafted and reviewed by a panel
of experts. Following numerous public complaints, though, the state
Department of Education suggested the wording change to clearly label
every scientific law and theory _ not just about evolution _ as such."

I just tried searching Findlaw.com, and either the site isn't indexed by
key words or I wasn't looking at the right court.  Perhaps Sally, Queen
of Reference, can locate the opinion - if one has been issued.
